Filing Requirements

The following is intended only as the barest outline of filing requirements to answer the most basic questions. For detailed filing requirements, visit the Current Court Rules web page or the Clerk's Office Internal Operating Procedures.

Where to File

With one exception, a document is considered "filed" in the Supreme Court only when it is actually received by the Clerk's Office in Lansing. That exception, known as the "prison mailbox rule" (see MCR 7.305[C][4]), applies only to certain prisoners acting in pro per in criminal appeals. The Clerk's Office is open between 8:30 AM and 5:00 PM, Monday through Friday except on Court holidays and emergency closures

Documents may be electronically filed 24 hours a day, seven days a week (with occasionally outages for scheduled maintenance).  Documents submitted to TrueFiling before 11:59:59 PM on a business day are docketed as being received that day.  Administrative Order No. 2014-23, sec. IX.

Number of Copies

Effective January 1, 2018, only one signed copy of any document type has to be filed with the Court.

Filing Fees

Application or original action = $375.
Motion for Immediate Consideration or to Expedite the Appeal = $150
Other motions = $75
For civil actions commenced in the Supreme Cout = additional $25 e-filing service fee.

If filing in hard copy, you should not bind or staple the document because it makes scanning or copying difficult.  Instead, you should use binder clips or rubber bands.
